1. License and Site Content
You agree that the Site itself, as well as all content, videos, training materials, products, services, and/or other materials made available on the Site by us or other third parties, as well as the look and feel of all of the foregoing (collectively referred to as the "Content"), are maintained for your personal use and information by Jeneration PR, LLC (the "Company") and are the property of the Company and/or its third-party providers.
You agree that such Company Content shall include all proprietary videos, HTML/CSS, Javascript, graphics, voice and sound recordings, artwork, photos, documents, and text, as well as all other materials included in the Site, excluding only the materials you provide. Subject to your compliance with these Terms of Use, the Company hereby grants you a limited license, which is non-exclusive, non-transferable, and non-sublicensable, to access, view, and use the Site solely for your personal purposes. No Company Content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, used for public or commercial purposes, or downloaded in any way unless written permission is expressly granted by the Company. Modification of the Content or use of the Content for any other purpose is a violation of the copyright and other proprietary rights of the Company, as well as other authors who created the materials, and may be subject to monetary damages and penalties. You may not distribute, modify, transmit, or use the content of the Site or any Content, including any and all software, tools, graphics, and/or sound files, for public or commercial purposes without the express written permission of the Company.

The use of Content by you is strictly prohibited unless specifically permitted by these Terms of Use. Any unauthorized use of Content may violate the copyright, trademark, and other proprietary rights of the Company and/or third parties, as well as the laws of privacy and publicity, and other regulations and statutes.
Nothing contained in these Terms of Use or in the Site shall be construed as granting, by implication or otherwise, any license or right to use any trademark or other proprietary information without the express written consent of the Company or third-party owner. The Company respects the copyright, trademark, and all other intellectual property rights of others. The Company has the right, but has no obligation, to remove content and accounts containing materials that it deems, in its sole discretion, to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene, or otherwise objectionable or violates any party's intellectual property or these Terms of Use.
If you believe that your intellectual property rights are being violated and/or that any work belonging to you has been reproduced on the Site or in any Content in any way, you may notify Company at [email protected]. Please provide your name and contact information, the nature of your work and how it is being violated, all relevant copyright and/or trademark registration information, the location/URL of the violation, and any other information you believe is relevant.
4. Accuracy of Information
While the Company uses reasonable efforts to include accurate and up-to-date information in the Site, the Company makes no warranties or representations as to its accuracy. The Company assumes no liability or responsibility for any errors or omissions in the content of the Site.
5. Electronic Communications

You consent to receive notices electronically by way of transmitting the notice to you by email.
6. Submissions
If you send comments or suggestions about the Site to the Company, including, but not limited to, notes, text, drawings, images, designs, or computer programs, such submissions shall become, and shall remain, the sole property of the Company. No submission shall be subject to any obligation of confidence on the part of the Company. The Company shall exclusively own all rights to (including intellectual property rights thereto), and shall be entitled to unrestricted use, publication, and dissemination as to all such submissions for any purpose, commercial or otherwise, without any acknowledgment or compensation to you.
7. Support Response Time
The Site administrators and support team aim to respond to support requests within 48 business hours. This response time may vary during high-demand periods or holidays. While we strive to address inquiries promptly, delays may occasionally occur due to volume or complexity of the request. Support inquiries should be directed to [email protected], and users are encouraged to provide detailed information to facilitate quicker assistance.
8. Coaching Services and Third-Party Coaches
The Company reserves the right to employ guest coaches or independent contractors to deliver coaching services or support as part of the Site's offerings. Such co-coaches and guest coaches are selected based on their qualifications and experience to provide the highest quality support to our members. All third-party coaches are bound by agreements to uphold the Site's standards and confidentiality obligations, as well as our commitment to customer privacy and quality.
9. Security and Data Privacy
The Company shall use commercially reasonable efforts to restrict unauthorized access to our data and files. However, no system, whether or not password protected, can be entirely impenetrable. You acknowledge that it may be possible for an unauthorized third party to access, view, copy, modify, or distribute the data and files you store using the Site. Use of the Site is completely at your own risk.
10. Privacy Policy Compliance
The Company will not intentionally disclose any personally identifying information about you to third parties, except where the Company, in good faith, believes such disclosure is necessary to comply with the law or enforce these Terms of Use. By using the Site, you signify your acceptance of the Company's Privacy Policy, https://www.jenerationacademy.com/pages/privacy-policy. If you do not agree with this Privacy Policy, in whole or part, please do not use this Site.
11. Disclaimers and Limitations of Liability
Neither the Company nor any other party involved in creating, producing, or maintaining the Site and/or any Content on the Site shall be liable under any circumstances for any direct, incidental, consequential, indirect, or punitive damages arising out of your access to or use of the Site. All Content on the Site is provided "as is" without warranty of any kind, either expressed or implied. The Company does not warrant that use of the materials will be uninterrupted or error-free. You assume all responsibility for the cost of all necessary repairs or corrections.
12. Third-Party Service Providers
The Company shall not be responsible for any performance or service problems caused by any third-party website or third-party service provider. Any such problem shall be governed solely by the agreement between you and that provider. The Company reserves the right to determine, in its sole discretion, whether the Company is responsible for any such malfunction or disruption. The Company may, in its sole discretion, refund the initial fee charged for any use of the Site and/or any Content or a pro-rata portion thereof consistent with the Company's refund policy. The Company shall refuse any refund thirty (30) days after your payment for use of the Site and/or any Content.
13. Intellectual Property and Limited License for Coaching Content
All materials provided as part of the coaching program, including documents, videos, templates, and proprietary strategies, remain the exclusive intellectual property of the Company. Members are granted a limited, non-transferable license to use these materials solely for personal education. Any distribution, replication, or public sharing of these materials is strictly prohibited without express written consent from the Company.
13a. Modification and Discontinuation of Program Features
The Company reserves the right, at its sole discretion, to modify, update, discontinue, or sunset any individual feature, tool, bonus, session, or component of any program or membership, including but not limited to live calls, coaching sessions, community platforms, templates, and review services, at any time and without obligation to provide advance notice. Such changes do not constitute a material breach of these Terms of Use or of any program agreement, and members are not entitled to a refund, credit, or extension on the basis of a discontinued feature. Where reasonably practicable, the Company will make efforts to notify affected members of significant changes to program features, but the absence of such notice does not affect the validity of this provision.
14. Cancellation and Refund Policy for Coaching Services
The Pitch Lab Monthly Plan: Six-Month Minimum Commitment. The monthly plan for the new version of The Pitch Lab (purchased on or after December 1, 2024) is a six-month minimum commitment, not a month-to-month subscription. By purchasing the monthly plan, you agree to make six (6) consecutive monthly payments at the price shown at checkout, whether or not you continue to use The Pitch Lab. The commitment begins on the date of your first payment. You will be asked to confirm this commitment at checkout before your purchase is completed.
Cancelling During the Minimum Term. You may cancel at any time, but cancellation during the first six months does not end your payment obligation. If you cancel before your sixth payment, (a) your cancellation will be treated as a request not to renew after the sixth payment, (b) your access will continue through the end of the six-month term, and (c) the Company may charge, or continue to charge, the payment method on file for each remaining payment through the sixth. Cancelling through your customer hub, your account settings, or support, or removing or replacing your payment method, does not release you from the remaining payments. If a scheduled payment fails, it remains due, and the Company may retry the charge, suspend access, or invoice you for the balance.
After the Minimum Term. After your sixth payment, the monthly plan continues month to month at the same price until you cancel. You may cancel at any time after the sixth payment. Cancellation applies only to future billing cycles, and no refunds or prorations apply to fees already paid.
Legacy The Pitch Lab Subscriptions: Legacy subscriptions (memberships of The Pitch Lab purchased before December 1, 2024) may be canceled at any time. Cancellations apply only to future billing cycles, and no refunds or prorations apply to already paid fees, regardless of usage.
The Pitch Lab Pay-in-Full and Other Payment Plans: Any other payment plan for the new version of The Pitch Lab, and payment plans for the Agency Accelerator and any other program, are non-cancellable. Cancellations do not apply to current payment cycles or amounts due on an existing payment plan. Once a payment plan begins, full payment is due, as outlined in the program agreement.
30-Day Guarantee: All products and services are backed by a 30-day guarantee. For subscription-based products, including the Pitch Lab monthly plan, the guarantee applies only to the first month of the subscription. If you are not satisfied within the first 30 days of your initial subscription or product purchase, you may contact [email protected] for assistance. Refund requests under the guarantee must be made within the 30-day period. A refund granted under the guarantee ends the plan, and no further payments are due. Refunds are not available beyond this timeframe.
Refund Policy: Due to the nature of the product, refunds are not available for any product or service offered after the 30-day guarantee period. All purchases are final.
Non-Transferability: Subscriptions, payment plans, and access rights to courses, memberships, or programs are non-transferable. No remaining term may be transferred to another individual or account.
Resolution Requirement Before Disputes: Customers are required to contact [email protected] for assistance and resolution of any issues related to payments or cancellations before initiating a dispute with their financial institution. This step is mandatory to ensure a smooth resolution process. Initiating a chargeback or payment dispute for a payment due within the commitment term, without first contacting support, is a breach of these Terms of Use. In that case the Company may contest the dispute, suspend access, and recover the unpaid balance, together with reasonable collection costs to the extent permitted by law.
Customers With Mandatory Consumer Rights: Nothing in these Terms of Use limits any right you have under mandatory consumer protection law that cannot be waived by agreement, including any statutory right of withdrawal or cancellation. If you are located in the European Economic Area, the United Kingdom, or another jurisdiction where such rights apply, those rights apply to you to the extent required by law, and the Company will honor valid requests made under them. Where such rights apply, the six-month commitment and the non-cancellation provisions above apply only to the extent the law allows.
Simple Cancellation Process: Customers can manually cancel their subscriptions directly from their accounts by following these steps. For the Pitch Lab monthly plan, cancelling during the minimum term stops renewal after the sixth payment, as described above.
- Log in to your account.
- Click on your avatar in the page header.
- Select Settings from the dropdown menu.
- Click Billing Info in the top right corner of the page.
If you encounter any issues or prefer to have support assist with the cancellation, please email your request to [email protected]. The Company aims to process all cancellation requests promptly. Cancellations will be effective upon confirmation by the Company.
15. Code of Conduct for Course Participants
All participants are expected to engage respectfully within the Site and any associated community platforms. Harassment, discrimination, or disruptive behavior will not be tolerated. The Company reserves the right to suspend or terminate access to the Site and its resources for any participant who fails to adhere to these standards.
16. No Guarantee of Results
The Company provides tools, techniques, and educational resources intended to aid in your professional development. However, individual results may vary, and the Company makes no guarantees as to the success or outcomes that may be achieved as a result of using the Site, participating in coaching sessions, or applying the Content provided. Any testimonials or examples on the Site are illustrative only and not indicative of typical results.
17. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms of Use or any activity related to your use of the Site (including negligent or wrongful conduct) by you or any other person accessing the Site using your Internet account.
18. Changes to Terms and Conditions
The Company reserves the right, at its sole discretion, to change, modify, add, or remove any portion of these Terms of Use, in whole or in part, at any time. Notification of changes in the Terms of Use will be posted on the Site. Changes will be effective immediately upon being posted on the Site, and your continued use of the Site after any such changes will constitute your acceptance of the new Terms of Use.
19. Governing Law and Jurisdiction
These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law provisions. You hereby agree that any dispute arising out of or related to these terms or the Site shall be resolved in the state or federal courts located in Los Angeles, CA.
20. Severability
If any provision of these Terms of Use is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.
21. Entire Agreement
These Terms of Use, along with any disclaimers and policies posted on the Site, constitute the entire agreement between you and the Company with respect to the use of the Site and Content. Any amendments or waivers to these Terms of Use must be in writing and signed by an authorized representative of the Company.
22. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to use the Site, purchase any Content, or join any program. By using the Site or making a purchase, you confirm that you meet these requirements.
23. Community Contributions and Content Standards
If you post, share, or submit anything in a community platform, live call, forum, review, or other interactive feature of the Site ("User Contributions"), you grant the Company a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, display, and distribute it in connection with the Company's business. You confirm that you own or control all rights in your User Contributions.
User Contributions must not: (a) be unlawful, defamatory, harassing, discriminatory, obscene, or otherwise objectionable; (b) infringe the intellectual property, privacy, or publicity rights of any person; (c) advertise or solicit other members without the Company's permission; (d) impersonate any person or misrepresent your affiliation; or (e) disclose another person's confidential information without permission. The Company may remove any User Contribution and suspend or terminate access at its sole discretion, consistent with Section 15.
24. Prohibited Uses
You may not: (a) use any bot, scraper, or other automated means to access or copy the Content; (b) share your login or allow any other person to access your account; (c) resell, sublicense, or give others access to the Content; (d) interfere with the security or operation of the Site; (e) introduce any virus or other harmful code; or (f) use the Site for any unlawful purpose. The Company may suspend or terminate your access for any violation, without refund.
25. Earnings and Results Disclaimer
The Company has not made and does not make any representation about the earnings, clients, press placements, or other results you may receive from participating in any program. The Company cannot and does not guarantee that you will achieve any particular result. Results differ for each individual and depend on your effort, experience, market, and circumstances. Any examples, case studies, or testimonials are not typical, and you are solely responsible for your own business decisions. This Section supplements Section 16.
26. No Professional Advice
The Content is provided for general educational purposes only. It is not legal, financial, tax, accounting, medical, or other professional advice, and the Company disclaims responsibility for the accuracy or reliability of any such information. You should consult a qualified professional before relying on it.
27. Cap on Liability
In addition to Section 11, and to the fullest extent permitted by law, the Company's total liability to you for any claim arising out of or relating to the Site, the Content, or any program will not exceed the fees you actually paid to the Company for the specific product or service that gave rise to the claim. Nothing in these Terms of Use limits any liability that cannot be excluded or limited under applicable law, including the consumer rights described in Section 14.
28. Force Majeure
The Company will not be liable for any failure or delay in performing under these Terms of Use that results from events beyond its reasonable control, including acts of God, fire, flood, epidemic, war, terrorism, civil unrest, government action, labor disputes, internet or telecommunications failures, power outages, or failures of third-party platforms.
29. No Waiver
The Company's failure or delay in enforcing any provision of these Terms of Use, including any payment, commitment, or cancellation term, is not a waiver of that provision or of any other. Any waiver is effective only if it is in writing and signed by an authorized representative of the Company. A refund, early release, or other accommodation given to one customer on one occasion is a courtesy only and does not waive these Terms of Use for that customer on any later occasion or for any other customer.
